GardenBot Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of GardenBot, including the GardenBot mobile app, websites, cloud services, account features, subscription features, plant-care tools, AI-assisted features, and related support services (together, the “Service”).
GardenBot is operated by Anton Petrov, a sole proprietorship registered in Poland (“GardenBot”, “we”, “us”, or “our”). You can contact us at support@garden-bot.app.
By downloading, accessing, or using GardenBot, you agree to these Terms. If you do not agree, do not use the Service.
1. Apple App Store EULA
If you downloaded GardenBot from the Apple App Store, Apple’s standard End User License Agreement applies to your license to use the GardenBot app, unless Apple or GardenBot provides a different license for your jurisdiction.
These Terms supplement that app license and govern the GardenBot Service, including accounts, cloud sync, AI features, subscriptions, user content, support, and acceptable use. If these Terms conflict with Apple’s terms for App Store purchases, billing, refunds, or the app license, Apple’s terms control for those matters.
2. Eligibility
GardenBot is not directed to children under 13. You must be at least 13 years old to use the Service. If you are under the age of majority in your country, you may use GardenBot only with permission from a parent or legal guardian, and your parent or guardian is responsible for your use of the Service.
3. Accounts
GardenBot may let you use the Service with an Apple, Google, email, or guest account. You are responsible for keeping your account secure and for all activity under your account.
You agree to provide accurate account information where requested and to use only accounts and credentials that you are authorized to use. You may not transfer, sell, or share your account in a way that bypasses GardenBot’s access controls, subscriptions, quotas, or safety limits.
Guest accounts are intended as a lightweight way to start using the app. Guest accounts may have limited recovery options. If you delete the app, change devices, lose local data, or do not convert a guest account to a signed-in account, some data may be difficult or impossible to recover.
4. The GardenBot Service
GardenBot helps users organize houseplant information, track plant-care actions, schedule reminders, browse plant information, identify plants from photos, and ask AI-assisted plant-care questions.
The Service may include:
- plant profiles, rooms, care schedules, care history, and reminders;
- camera and photo-library flows for plant photos and AI identification;
- global and plant-specific AI chat;
- curated plant database content and care hints;
- free and paid access levels;
- feedback and support flows;
- cloud sync, offline cache, and recovery features.
GardenBot is intended for general houseplant-care assistance. It is not a professional horticulture, veterinary, medical, toxicology, emergency, or safety service.
5. AI Features and Plant Advice
GardenBot uses AI-assisted systems, including third-party AI and cloud services, to process plant photos, chat messages, plant context, and related information in order to provide plant identification, care suggestions, care-plan hints, and chat responses.
AI output may be incomplete, inaccurate, outdated, or unsuitable for your specific plant, environment, home, pets, or household members. You are responsible for reviewing AI output before relying on it.
You should not use GardenBot as the only source for decisions involving:
- poisonous or irritating plants;
- plants that may affect children, pets, allergies, or health;
- expensive, rare, or commercially important plants;
- pest infestations, mold, fungi, chemicals, fertilizers, pesticides, or other hazardous materials;
- any urgent safety issue.
For serious plant-health, toxicity, pet, human-health, chemical, or safety concerns, consult an appropriate professional or local authority.
We may limit, pause, change, or disable AI features for safety, quality, abuse-prevention, cost-control, technical, legal, or operational reasons.
6. User Content
“User Content” means information or materials you submit, upload, create, store, send, or otherwise provide through GardenBot, including plant names, plant photos, room names, care schedules, care history, chat messages, AI prompts, feedback messages, support emails, and attachment images.
You retain ownership of your User Content. You grant GardenBot a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, adapt, and use your User Content as needed to operate, secure, maintain, improve, and provide the Service. This includes using User Content to generate AI responses, sync your data, process support requests, enforce quotas, prevent abuse, troubleshoot errors, and comply with law.
You represent that you have the rights needed to provide your User Content and allow GardenBot to process it under these Terms.
You agree not to upload or send User Content that:
- infringes another person’s rights;
- is unlawful, abusive, deceptive, harmful, or malicious;
- contains malware or attempts to interfere with the Service;
- includes private information about other people without their permission;
- contains images of people, children, documents, payment cards, passwords, or other sensitive non-plant information unless clearly necessary for support and you have the right to provide it.
GardenBot is designed for plant-related content. We may remove, block, or restrict User Content if we reasonably believe it violates these Terms, creates legal or security risk, or harms the Service.
7. Feedback
If you send us feedback, bug reports, ideas, suggestions, ratings, comments, screenshots, or similar materials, you grant GardenBot permission to use them without restriction or compensation to you. This helps us improve the Service, fix issues, develop features, and respond to support requests.
Feedback may be submitted through the app or by email. Please do not include sensitive personal information in feedback unless it is necessary for your support request.
8. Free Features and GardenBot Pro
GardenBot may offer free features and paid features. Free access may include limits on plants, AI usage, identification attempts, reminders, sync, storage, or other capabilities. Free limits may change over time and may be configured remotely.
GardenBot Pro is an auto-renewable subscription that may include benefits such as unlimited plants, reminders, and AI chat access, subject to fair use, abuse-prevention controls, safety limits, technical availability, operational limits, and any quotas, counters, or restrictions shown in the app.
GardenBot Pro currently supports monthly and annual subscription options where available. Subscription names, prices, durations, included features, trials, offers, taxes, and availability are shown in the app or by the App Store before purchase and may vary by country, currency, storefront, and time.
9. App Store Billing, Renewal, Cancellation, and Refunds
Purchases and subscriptions made through the Apple App Store are billed by Apple to your Apple Account. GardenBot does not directly process App Store payments.
Unless canceled, auto-renewable subscriptions renew automatically. Your Apple Account may be charged for renewal within 24 hours before the end of the current subscription period. You can manage or cancel your subscription in your Apple Account subscription settings.
Deleting the GardenBot app, deleting your GardenBot account, disabling AI features, or stopping use of the Service does not automatically cancel an App Store subscription. You must cancel the subscription through Apple if you do not want it to renew.
Refunds, billing disputes, family sharing, payment failures, chargebacks, and App Store purchase issues are handled by Apple according to Apple’s policies. GardenBot may provide restore-purchase and entitlement-sync tools, but access to paid features depends on valid purchase and entitlement information from Apple, RevenueCat, or our backend systems.
If your subscription expires, is canceled, is refunded, cannot be verified, or is affected by a billing issue, we may downgrade your account or restrict access to paid features.
10. Fair Use and Acceptable Use
You agree to use GardenBot responsibly and only for lawful purposes.
You may not:
- bypass, manipulate, or reverse engineer subscription checks, quotas, energy balances, rate limits, App Check, security rules, or access controls;
- use bots, scrapers, automated clients, or bulk requests without permission;
- overload, disrupt, or attack the Service or its infrastructure;
- attempt to access another user’s account, plants, photos, chats, storage, or data;
- use the Service to generate spam, abusive content, illegal content, or content that infringes rights;
- resell, sublicense, rent, or commercially exploit GardenBot without our written permission;
- copy, modify, decompile, or reverse engineer the app except where applicable law expressly allows it;
- use AI features in a way that is unsafe, abusive, fraudulent, or outside the intended plant-care context.
We may limit, suspend, or terminate access if we reasonably believe your use violates these Terms, threatens the Service, creates legal risk, or harms other users.
11. Notifications and Reminders
GardenBot may provide reminders, local notifications, background refresh, and related scheduling features. Reminders are convenience tools only. Delivery may depend on your device settings, permissions, network conditions, operating system behavior, battery settings, time zone, and other factors outside our control.
You remain responsible for your plants and care decisions even if a reminder is delayed, missed, duplicated, inaccurate, or unavailable.
12. Availability, Updates, and Changes
We may update, change, limit, suspend, or discontinue any part of the Service at any time. This includes free limits, paid features, AI availability, model providers, plant database availability, prompt chips, remote configuration, app version requirements, and operational safeguards.
Some features require internet access, a supported app version, a valid account, a valid subscription, or backend availability. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available in every country, language, device, or App Store storefront.
We may require you to install an app update to continue using some or all features, especially when needed for security, compatibility, legal compliance, or service reliability.
13. Third-Party Services
GardenBot relies on third-party services and platforms, which may include Apple, Google, Firebase, Google Cloud, Google Sign-In, Firebase App Check, Firebase Authentication, Firestore, Cloud Storage, Cloud Functions, Remote Config, Analytics, Crashlytics, Vertex AI, Gemini models, RevenueCat, and StoreKit.
Third-party services may have their own terms, privacy policies, billing rules, availability limits, and account requirements. GardenBot is not responsible for third-party services except as required by applicable law.
14. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. It is available at https://garden-bot.app/privacy. By using GardenBot, you also acknowledge the Privacy Policy.
The Privacy Policy governs privacy-specific matters. These Terms govern your use of the Service.
15. Account Deletion and Data Deletion
You may delete your GardenBot account through the app where account deletion is available. Account deletion is intended to remove your GardenBot account record and associated personal data that we are not legally required or otherwise permitted to retain.
Account deletion may delete plants, rooms, plant photos, chat history, usage data, quota data, feedback-related account links, and related cloud data associated with your GardenBot account, subject to technical processing time, backups, security logs, legal obligations, billing records, fraud-prevention needs, and other lawful retention requirements.
Deleting your GardenBot account does not cancel an App Store subscription. If you have an active auto-renewable subscription, cancel it through Apple before or after account deletion if you do not want future renewals.
Guest accounts may also be deleted by the user. We may also delete inactive guest accounts and associated data after a period of inactivity, currently 90 days, unless the account is converted or activity resumes.
16. GardenBot Intellectual Property
GardenBot, including the app, design, software, source code, generated assets, icons, interface, logos, text, plant database content, prompts, workflows, and other materials, is owned by GardenBot or its licensors and is protected by intellectual property and other laws.
Subject to these Terms and the applicable App Store license, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use GardenBot for your own lawful personal use.
You may not use GardenBot’s name, branding, screenshots, database content, generated assets, or other materials in a way that suggests endorsement, confuses users, violates law, or infringes our rights.
17. Disclaimers
To the maximum extent permitted by law, GardenBot is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
We do not warrant that:
- plant identifications will be correct;
- care recommendations will fit your specific plant or environment;
- AI responses will be accurate, complete, safe, or current;
- reminders or notifications will be delivered on time;
- cloud sync will always succeed;
- data will never be lost;
- the Service will be uninterrupted, secure, or error-free.
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable consumer law.
18. Limitation of Liability
To the maximum extent permitted by law, GardenBot and its operators, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, plants, property, goodwill, or business opportunities.
To the maximum extent permitted by law, GardenBot’s total liability for claims arising out of or relating to the Service or these Terms will be limited to the greater of:
- the amount you paid for GardenBot Pro during the 12 months before the event giving rise to the claim; or
- EUR 50.
These limits do not apply where liability cannot be limited by law, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
19. Indemnity
If you use GardenBot on behalf of a business or organization, or if you misuse the Service, you agree to defend, indemnify, and hold harmless GardenBot from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of another person’s rights, to the extent permitted by law.
This section does not limit non-waivable consumer rights.
20. Suspension and Termination
You may stop using GardenBot at any time. We may suspend or terminate your access to the Service if we reasonably believe that:
- you violated these Terms;
- your use creates legal, security, operational, or reputational risk;
- your account or subscription cannot be verified;
- we must do so to comply with law, platform rules, or third-party service requirements;
- continuing to provide the Service is no longer commercially, technically, or legally practical.
After termination, sections of these Terms that by their nature should survive will continue to apply, including sections about subscriptions already purchased, user content licenses needed for lawful retention, intellectual property, disclaimers, liability limits, disputes, and governing law.
21. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by updating the date above, posting the new Terms, or showing a notice in the app or on our website.
Your continued use of GardenBot after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, stop using the Service and, if applicable, cancel your subscription through Apple.
22. Governing Law and Consumer Rights
These Terms are governed by the laws of Poland, except where mandatory consumer protection laws in your country of residence require otherwise.
If you are a consumer, you may have mandatory legal rights under the laws of your country or region. Nothing in these Terms is intended to limit rights that cannot be waived or limited by contract.
